Request To Speak at the October 12, 2023 Hearing Board Meeting:

If you would like to provide oral comments to the SDAPCD Hearing Board during the upcoming meeting, please email your request to the Clerk of the Hearing Board by 5 p.m. on Wednesday, October 11, 2023 at APCDvariance@sdapcd.org with your full name, email address, phone number and agenda item with your position on the item.  This will ensure the Board is aware you wish to speak on that item.

To submit written comments to the Board on agenda and non-agenda items, please submit written materials via email to APCDvariance@sdapcd.org or at 10124 Old Grove Road, San Diego 92131.

Reasonable accommodations will be made to accommodate oral interpretation at Hearing Board meetings upon request to the Clerk of the Hearing Board at least 72 hours prior to the hearing or meeting.

Petitioner/Respondent Hearing Board Meeting Information

You may consider adding visual presentations such as PowerPoint slides to communicate your position. Such presentations would need to be submitted to the Clerk of the Board a week prior to your hearing.

The Air Pollution Control District Hearing Board is composed of five members appointed by the Air Pollution Control District Governing Board. This Board is administered by the Clerk of the Air Pollution Control District Governing Board. The members of the Board have professional experience in the fields of medicine, engineering, law, and include two members of the public. The Board is an impartial entity established to hear and decide appeals from permit denials, application for variances from Air Pollution Control District Rules and Regulations, hear abatement order requests. Persons or companies requiring a Variance from the Air Pollution Control District Hearing Board may file a Request for Variance via email to APCDVariance@sdapcd.org, USPS mail, or in person at the office of the Air Pollution Control District c/o Governing Board Clerk, 10124 Old Grove Road, San Diego, CA 92131. For questions regarding this process, you may call (858) 688-7147 or email  APCDVariance@sdapcd.org . An appropriate fee is collected at the time the Variance is requested.

The San Diego County Air Pollution Control District is now accepting applications for members to join the Air Pollution Control District Hearing Board (in accordance with the California Health and Safety Code Section 40800). The available seats are for candidates meeting one of the following requirements:

  • Public Member
  • Public Alternate Member

The duties of the Hearing Board include consideration of variance requests from permitted entities, permit appeals from permittees or members of the public, and requests for abatement orders. The Hearing Board is made up of five members, which include one member admitted to practice law in California, one registered professional engineer, one member from the medical profession, and two public members.

Hearing Board members will be appointed by the APCD Governing Board during a public meeting and will serve a term of three years.
