Violation Settlement Program

Font Size Extra Large Font Size Large Font Size Default

The Air Pollution Control District's Violation Settlement Program offers recipients of a Notice of Violation the opportunity to settle violations out-of-court.  A Notice of Violation is issued for violations that may result in monetary penalties, civil suit, or in serious cases, criminal prosecution.

If you receive a Notice of Violation, take IMMEDIATE action to prevent the violation from recurring.  If you cannot immediately return to compliance, you may apply for a temporary variance from the District Hearing Board.

The District's Small Business Assistance Program assists business owners by providing compliance training, courtesy inspections, technical assistance and information to help facilities return to compliance.

Next, advise the District in writing of the action taken to correct the alleged violation or the reason(s) you think the violation did not occur.  Submit your response within ten days of the date the Notice of Violation was issued.  Read the Notice of Violation Fact Sheet for more detailed information.

Mail your response to:

Attention:  Compliance Division

OR fax it to (858) 586-2651,    Attention:  Compliance Division
